Terms of Services

Effective Date: 29 August 2026

Welcome to EssexNet. These Terms of Services explain the terms under which EssexNet provides its connectivity, communications and related services to customers. By accessing our website, requesting our services or entering into a service agreement with us, you agree to these terms.

1. Our Services

EssexNet provides business connectivity and network solutions, which may include:

  • Business broadband

  • Full Fibre and leased line connectivity

  • Managed Wi-Fi

  • Network security

  • Cloud voice and communications

  • Network monitoring and management

  • Installation and technical support

  • Other connectivity and communications services agreed with the customer

The exact services provided will depend on your requirements, location, technical feasibility and the service agreement entered into with EssexNet.

2. Service Availability

Services are subject to availability and technical feasibility at your premises.

Before providing certain services, we may need to carry out a site survey or technical assessment. Availability, connection speeds, installation times and network performance may vary depending on your location, infrastructure and other technical factors.

A request or enquiry submitted through our website does not guarantee that a particular service will be available.

3. Ordering Services

When you request a service, you may be required to provide accurate information about yourself, your business, your premises and your connectivity requirements.

An order will only become binding once it has been accepted by EssexNet and the applicable service agreement or order documentation has been confirmed.

Where specific service terms or a Service Level Agreement (SLA) applies, those terms will form part of your agreement with us.

4. Pricing and Payment

Service prices will depend on the service selected, location, installation requirements, equipment and other technical considerations.

Any pricing displayed on our website is for general information and may be subject to change.

The applicable charges, payment schedule, minimum contract period and any installation or equipment costs will be confirmed before the service is provided.

Customers are responsible for paying all charges by the agreed payment dates.

5. Installation

Where installation is required, you must provide reasonable access to your premises and any facilities required for installation.

Installation dates may change due to technical requirements, site conditions, third-party infrastructure providers, permits or circumstances outside our reasonable control.

We will make reasonable efforts to keep you informed of significant delays.

6. Customer Responsibilities

You are responsible for:

  • Providing accurate information to EssexNet.

  • Providing reasonable access to your premises when required.

  • Ensuring that your equipment and internal network are suitable for the service.

  • Using the service in accordance with applicable laws.

  • Keeping any account or login information secure.

  • Informing us of any relevant changes to your contact or service information.

  • Not making unauthorised changes to equipment supplied or managed by EssexNet.

7. Acceptable Use

Our services must not be used for unlawful, fraudulent, abusive or harmful activities.

You must not use our services to:

  • Send spam or malicious communications.

  • Distribute viruses, malware or harmful software.

  • Gain unauthorised access to networks, systems or accounts.

  • Interfere with the operation of our network or another customer’s service.

  • Infringe another person’s intellectual property or privacy rights.

  • Conduct any activity that violates applicable laws or regulations.

We may suspend or restrict a service where reasonably necessary to protect our network, systems, customers or third parties.

8. Service Performance

We aim to provide reliable and high-quality connectivity. However, actual performance may be affected by factors such as network conditions, customer equipment, internal Wi-Fi coverage, third-party infrastructure and local technical conditions.

Where a Service Level Agreement applies, service performance commitments and remedies will be governed by the applicable SLA.

9. Maintenance and Outages

We may occasionally need to carry out planned maintenance, upgrades, repairs or security work.

Where reasonably possible, we will provide advance notice of planned maintenance that is expected to affect your service.

Emergency maintenance may sometimes be required without advance notice where necessary to protect the network or restore service.

10. Equipment

Where EssexNet provides equipment as part of a service, the ownership, use, maintenance and return of that equipment will be governed by the applicable service agreement.

Customers must not intentionally damage, modify, relocate or interfere with EssexNet equipment without prior authorisation.

11. Technical Support

Technical support will be provided in accordance with the support arrangements applicable to your service.

To help us investigate an issue, you may be required to provide relevant information, access to equipment or access to your premises.

Issues caused by customer equipment, unauthorised modifications, third-party systems or circumstances outside EssexNet’s reasonable control may fall outside our standard support obligations.

12. Suspension of Services

We may suspend or restrict services where reasonably necessary, including where:

  • Payments are overdue.

  • There is a serious breach of these Terms of Services or the applicable service agreement.

  • The service is being used unlawfully or abusively.

  • Suspension is necessary to protect our network or other customers.

  • We are required to do so by law or a relevant authority.

Where appropriate, we will provide notice before suspending a service.

13. Cancellation and Termination

Cancellation and termination rights, notice periods and any applicable charges will be set out in the relevant service agreement.

If you wish to cancel a service, you should contact EssexNet using the contact details provided below.

Any outstanding charges or contractual obligations that apply following cancellation will remain payable.

You may not copy, reproduce, modify, distribute or commercially use our website content without our prior written permission.

15. Third-Party Services

Some EssexNet services may rely on third-party networks, infrastructure, software or service providers.

Where a service depends on a third party, availability and performance may be affected by circumstances outside EssexNet’s reasonable control.

Third-party services may also be subject to their own terms and conditions.

16. Limitation of Liability

EssexNet will take reasonable steps to provide reliable services but cannot guarantee uninterrupted or completely error-free connectivity.

To the maximum extent permitted by law, EssexNet will not be responsible for losses caused by circumstances outside our reasonable control, including failures of third-party networks or infrastructure, power failures, severe weather, natural events, cyber incidents or other events beyond our reasonable control.

Nothing in these Terms of Services excludes or limits any liability that cannot legally be excluded or limited.

Where you have a separate service agreement with EssexNet, the liability provisions contained in that agreement will apply.

17. Changes to Our Services or Terms

We may update our services or these Terms of Services from time to time to reflect changes in our business, technology, legal requirements or service offerings.

Where changes materially affect an existing service, we will provide any notice required under the applicable agreement or law.

The latest version of these Terms of Services will be made available on our website.

18. Privacy

Your personal information is handled in accordance with our Privacy Policy.

Our Privacy Policy explains what information we collect, how we use it, how we protect it and your rights regarding your personal information.

19. Governing Law

These Terms of Services are governed by the laws of England and Wales.

Any dispute arising in connection with these terms will be subject to the jurisdiction of the courts of England and Wales, unless applicable law provides otherwise.
